The ground rules, for the website.
These terms govern the use of the vinishu.io website.
1. Scope and provider
These Terms of Use govern the use of the website vinishu.io (the "Website"), operated by Vinishu GmbH, Zu den Fuchshöhlen 8, 99098 Erfurt ("we"). They govern only the use of this Website, including the Bot Check (section 6). Contracts for our products and services are concluded separately and are subject to their own terms. Our offering on this Website is directed exclusively at businesses (entrepreneurs within the meaning of Section 14 of the German Civil Code).
2. Website services and availability
The Website provides information about our company and our products and a means of contacting us. With the Bot Check (section 6), we also offer a free automated check of websites. We strive for availability that is as uninterrupted as possible, but we do not owe it. We may change, restrict, or discontinue operation of the Website at any time. There is no claim to constant availability.
3. Use of the Website
You may use the Website only in accordance with applicable law and these Terms of Use. In particular, the following are prohibited: interfering with the Website, automated extraction of content (scraping) without our consent, circumventing security measures, overloading the Website, and misuse of the contact form.
4. Content and intellectual property
All content on the Website (in particular texts, graphics, logos, images, and code) is protected by copyright and trademark law and belongs to us or our licensors. Any use, reproduction, or distribution beyond merely viewing the Website requires our prior consent. "Vinishu" and the Vinishu logo are our signs and marks.
5. Statements on performance characteristics
Statements about the performance of our products (e.g. latency, detection rates, availability) are based on internal measurements and are provided for general information only. They do not constitute warranted characteristics, guarantees, or binding performance commitments. Only the services agreed in the respective contract are decisive.
6. Bot Check
6.1 Description of the service
With the Bot Check, we offer a free, automated check on the Website that shows which forms on a website a bot could submit. To do so, our scanner retrieves the publicly accessible pages of the website you specify using an automated browser, currently up to 150 pages and for no longer than 90 seconds per check. The scanner reads the forms it finds and the protective measures it can detect. It does not submit forms, does not enter data into forms, does not attempt to log in, does not solve captchas or other bot challenges and does not circumvent access restrictions or login screens. If the website shows a bot block instead of a page, the scanner does not analyse that page any further. The forms found are assessed automatically, including by means of an AI service.
6.2 No entitlement to a check
We do not charge money for the Bot Check. For what you give in return, see section 6.8. There is no entitlement to a check being carried out, to a particular depth of checking or to the availability of the Bot Check. We may refuse requests, limit the number of checks, in particular per IP address, email address, domain or day, and cancel checks that are in progress. This applies in particular where there are indications that the authorisation under section 6.3 is missing or that the Bot Check is being misused.
6.3 Authorisation to check
You may only use the Bot Check for websites you are authorised to have checked. By submitting a request, you confirm that you are acting for the company that operates the website specified, or that you have been authorised by that company to have it checked. You also confirm that the details you enter in the form are accurate. Checking third-party websites without such authorisation is prohibited.
6.4 Indemnity
If a third party brings a claim against us because of a check that you requested without authorisation in breach of section 6.3, you shall indemnify us against such claims. The indemnity includes the reasonable costs of our legal defence. It does not apply to the extent that you are not responsible for the breach.
6.5 Significance of the result
The result is an automated assessment at the time of the check. It may be incomplete or inaccurate, for example if pages could not be reached, a bot block prevented retrieval or forms only appear after logging in. The Bot Check is not a security audit, a penetration test or advice. The fact that the Bot Check does not find or does not flag a form does not mean that this form is protected against bots. Risk levels and assessments are based on our own weighting. They are neither warranted characteristics nor a guarantee.
6.6 Result page
The result can be accessed for 30 days via a link containing a randomly generated identifier. Anyone who knows this link can see the checked address and all findings. You decide who you share the link with.
6.7 Our use of results
We may analyse the results of checks in aggregated form that does not allow any conclusions to be drawn about a specific website, company or person, for example for statistics and to improve our products. We only publish results that identify a specific website with the consent of the company that operates it.
6.8 Consent and data protection
Using the Bot Check requires your consent to email contact under section 8.5 of our privacy policy. We do not charge money for the Bot Check. Your consent is what you give in return. If you withdraw it, a check already carried out remains unaffected, as does the result page under section 6.6. Section 8 of our privacy policy sets out which data we process for the Bot Check, for what purposes and for how long we store it.
7. Liability for our content
We prepare the Website content with care but do not warrant that it is current, accurate, or complete. Otherwise, our liability is governed by section 9.
8. External links
The Website may contain links to third-party websites whose content we do not control. The respective provider is always responsible for such external content. At the time of linking, no legal violations were apparent; we will remove such links upon becoming aware of any legal violations.
9. Liability
We are liable without limitation for intent and gross negligence and for damage arising from injury to life, body, or health. In the case of ordinary negligence, we are liable only for the breach of a material contractual obligation (cardinal obligation) and limited in amount to the foreseeable damage typical for such contracts. Otherwise, liability is excluded. Mandatory statutory liability - for example under the German Product Liability Act - remains unaffected.
10. Changes to these Terms of Use
We may change these Terms of Use with effect for the future. The version published at the time of use applies.
11. Governing law and jurisdiction
The law of the Federal Republic of Germany applies. The exclusive place of jurisdiction for all disputes arising from or in connection with the use of this Website is - insofar as you are a merchant, a legal entity under public law, or a special fund under public law - Erfurt.
12. Severability
Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.
In case of discrepancies, the German version prevails.
